These Terms & Conditions govern your use of the Skills Hampshire website and your participation in Skills Hampshire programmes, events and other activities.
By applying for, registering for or participating in a Skills Hampshire programme or event, you agree to the relevant provisions of these Terms & Conditions.
1. About Skills Hampshire
Skills Hampshire is a Hampshire-focused workforce development initiative established to support local businesses, employees and individuals through professional development, training, events, networking and related opportunities.
Skills Hampshire aims to increase access to professional development and contribute to the skills, productivity and capability of Hampshire's workforce.
The legal entity responsible for providing a particular programme or service will be identified where required as part of the relevant registration, application or programme information.
2. Website Use
The Skills Hampshire website is provided for general information, programme applications, event registrations and access to information about Skills Hampshire activities.
You agree not to:

Use the website for unlawful or fraudulent purposes

Attempt to gain unauthorised access to the website or associated systems

Introduce viruses, malicious software or other harmful material

Submit deliberately false or misleading information

Copy or commercially exploit website content without permission
We may restrict access to the website where reasonably necessary for security, maintenance or operational purposes.
3. Skills Hampshire Programmes
Skills Hampshire may provide fully funded or subsidised professional development programmes to eligible businesses and individuals.
Individual programmes may have their own:

-
Learner requirements
-
Maximum number of places

Course content

Events or live sessions

Completion criteria
These will be communicated as part of the relevant programme.
Submitting an application or expression of interest does not automatically guarantee a place.
Places may be limited and applications may be assessed against the relevant programme criteria.
4. Fully Funded Places
Where a programme is described as fully funded, eligible participants will not be charged a tuition or programme fee for the funded elements expressly included within that programme.
Unless specifically stated otherwise, participants remain responsible for their own incidental expenses, which may include travel, accommodation or other costs associated with attending optional or physical events.
Funding is subject to eligibility, availability and the specific conditions of each programme.
A funded place has an underlying value and should be treated as a genuine commitment to professional development.
5. Eligibility
Eligibility requirements may vary between Skills Hampshire programmes.
Applicants must provide accurate and complete information when applying.
Where a programme is restricted by location, employment status, organisation size, role or another criterion, Skills Hampshire may request reasonable evidence to confirm eligibility.
We reserve the right to reject or withdraw an application where information supplied is materially inaccurate, misleading or where the applicant does not meet the published eligibility criteria.
6. Employer Nominations
Businesses may be permitted to nominate employees for Skills Hampshire programmes.
Where an employer nominates an individual, the employer should ensure that:

The individual is aware of the nomination

Appropriate contact information has been provided

The individual is reasonably able to participate
-
Any information supplied is accurate
-
The employer has an appropriate basis for providing the individual's information
Limits may apply to the number of funded places available to a single organisation.
7. Accepting a Funded Place
Funded programme places are limited.
Once a place has been offered and accepted, we ask participants to make a reasonable commitment to completing the programme.
If you are unable to participate, you should notify Skills Hampshire as soon as reasonably possible so that the place may be offered to another eligible participant.
Where a participant does not begin their programme, becomes persistently inactive or confirms that they no longer intend to participate, Skills Hampshire may withdraw and reallocate the funded place after reasonable attempts to contact the participant.
There will ordinarily be no financial penalty for failing to complete a fully funded programme unless a separate written agreement expressly states otherwise.
8. Programme Participation
Participants are expected to:

Engage with the programme in good faith

Complete their own learning and assessments

Treat other participants, staff, speakers and partners respectfully

Avoid sharing login credentials

Avoid attempting to manipulate assessments or completion records

Use programme materials for legitimate learning purposes

Comply with reasonable instructions relating to events, webinars and programme activities
Serious or repeated misuse may result in removal from a programme.
9. Programme Content
Programme content may include a combination of:

Self-paced online learning
-
Video content
-
Written learning materials
-
Assessments
-
Virtual classrooms
-
Webinars
-
Guest speakers
-
Workshops
-
Networking opportunities
-
Physical resources
-
Alumni activities
The exact content will depend on the programme.
We may make reasonable changes to programme content, speakers, schedules, delivery methods or supporting resources where necessary to improve delivery or respond to circumstances outside our reasonable control.
Where a significant change materially affects a participant, we will endeavour to communicate this appropriately.
10. Programme Dates
Programme start dates, deadlines and event dates will be communicated to participants.
Participants are responsible for making reasonable efforts to meet applicable deadlines.
We may extend or amend programme dates where reasonably necessary.
Where a live event, webinar or session needs to be postponed or rescheduled, we will endeavour to provide reasonable notice.
11. Completion and Certification
Certificates or other recognition of completion may be issued where a participant satisfies the relevant programme requirements.
Requirements may include:

Completion of required learning

Completion of assessments
-
Achievement of a specified assessment result

Participation in required programme elements
A place on a programme does not itself guarantee successful completion or certification.
12. Events
Skills Hampshire may organise networking events, workshops, webinars, alumni events and other activities.
Individual events may be subject to additional venue or registration requirements.
Participants are expected to behave appropriately and respectfully.
We reserve the right to refuse admission or require an individual to leave an event where their behaviour presents a reasonable safety concern, causes serious disruption or is abusive, threatening or inappropriate.
13. Food, Allergies and Accessibility
Where food or refreshments are provided at an event, attendees should notify us of relevant allergies or dietary requirements when requested.
While reasonable efforts may be made to accommodate dietary requirements, we cannot guarantee that an event environment will be completely free from particular allergens.
Participants with accessibility requirements are encouraged to contact us in advance so that reasonable arrangements can be considered.
14. Photography and Media
Photography or video recording may take place at certain Skills Hampshire events.
Where appropriate, attendees will be informed that photography or filming is taking place.
If you do not wish to appear in identifiable promotional photography or video, please notify a member of the Skills Hampshire team.
Where specific consent is required for a particular use, it will be requested separately.
15. Intellectual Property
Unless otherwise stated, programme materials, website content, presentations, videos, graphics, assessments, workbooks, playbooks and other resources provided through Skills Hampshire remain the intellectual property of their respective owners.
Participants may use materials provided to them for their own personal or internal professional development.
Materials must not be:

Resold
-
Republished commercially
-
Reproduced in substantial form for commercial purposes

Uploaded to other learning platforms
-
Distributed as another organisation's training material
-
Presented as the participant's or employer's own intellectual property
without prior permission from the relevant rights holder.
16. Account Security
Where participants receive access to an online learning platform, they are responsible for keeping their login information reasonably secure.
Accounts are intended for the registered learner and should not be shared.
We may suspend access where we reasonably believe an account is being misused, compromised or shared without authorisation.
17. Availability of Online Services
We aim to make online learning and programme services reasonably available.
However, we cannot guarantee uninterrupted or error-free access at all times.
Temporary disruption may occur because of maintenance, updates, technical problems, internet outages or circumstances outside our reasonable control.
Where a significant outage affects a programme deadline, we will consider reasonable adjustments where appropriate.
18. Third-Party Services
Skills Hampshire programmes may involve third-party technology providers, venues, speakers, trainers or other delivery partners.
Where third-party services are provided directly by another organisation, their own terms or policies may also apply.
We are not responsible for the independent actions of third parties where those actions are outside our reasonable control, although this does not affect any responsibility that cannot lawfully be excluded.
19. Educational and Professional Information
Skills Hampshire programmes are designed for education and professional development.
Information provided through a programme is general in nature unless expressly stated otherwise.
Participants and employers remain responsible for decisions made within their own organisations and for obtaining appropriate specialist advice where required.
Participation in a Skills Hampshire programme does not guarantee employment, promotion, increased revenue, improved business performance or any particular commercial outcome.
20. Cancellation by Skills Hampshire
In exceptional circumstances, we may need to cancel, postpone or materially change a programme or event.
This may include circumstances involving insufficient participation, venue availability, speaker availability, technology issues, safety concerns or circumstances outside our reasonable control.
Where this happens, we will endeavour to provide affected participants with reasonable notice and, where practicable, an alternative arrangement.
21. Liability
Nothing in these Terms & Conditions excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
Subject to applicable law, Skills Hampshire and the relevant programme provider will not be responsible for losses arising solely from circumstances outside their reasonable control.
Participants and employers remain responsible for how they apply information obtained through Skills Hampshire within their own workplace or organisation.
Nothing in these Terms & Conditions affects any statutory rights that cannot lawfully be excluded or restricted.
22. Privacy and Personal Information
Personal information collected through Skills Hampshire will be handled in accordance with the Skills Hampshire Privacy Policy and applicable data protection legislation.
This may include information required to:

Record participation and completion

23. Communications
Participants may receive operational communications relating to programmes for which they have applied, registered or enrolled.

Requests for feedback
These communications may be necessary for administering the programme and are separate from optional marketing communications.
24. Feedback and Testimonials
We may invite participants and employers to provide feedback about their experience.
Providing a testimonial or participating in promotional activity is voluntary unless a particular programme expressly states otherwise before enrolment.
Where we wish to use an identifiable testimonial, photograph, case study or other personal endorsement publicly, appropriate permission will be obtained where required.
25. Changes to These Terms
We may update these Terms & Conditions from time to time to reflect changes in our programmes, website, legal requirements or operational arrangements.
The latest version will be published on the Skills Hampshire website.
Changes will not retrospectively remove rights that a participant already has under an existing agreement.
Where a material change directly affects an active programme, we will take reasonable steps to notify affected participants where appropriate.
26. Severability
If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
27. Governing Law
These Terms & Conditions are governed by the laws of England and Wales.
Nothing in these Terms is intended to restrict any rights regarding jurisdiction that an individual may have under applicable law.
